Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://medimatch.app, the MediMatch mobile applications for iOS and Android, and any related services (together, the "Services") provided by MediMatch ("MediMatch", "we", "us", or "our"). By creating an account, joining our waitlist, downloading our app, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. About MediMatch
MediMatch is a directory and availability-matching service that helps patients find pharmacies that may have a prescribed medication in stock, see what services a pharmacy offers, check opening hours, and contact or get directions to a pharmacy.
MediMatch is not a pharmacy.
- We do not dispense, sell, prescribe, or handle medication.
- We do not provide medical advice, diagnosis, or treatment.
- We are not a party to any transaction between you and a pharmacy; each pharmacy is an independent business responsible for its own stock, pricing, and service.
2. Eligibility
You must be at least 16 years old to use the Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
3. Not for medical emergencies
The Services are not intended for use in a medical emergency. If you are experiencing a medical emergency, call your local emergency number or go to the nearest emergency room immediately. Do not rely on MediMatch to locate urgent or emergency medication.
4. Accounts and waitlist
- You must provide accurate, current, and complete information when you sign up or join our waitlist.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Joining the waitlist does not guarantee access to MediMatch, a particular launch date, or availability in your area.
- We may suspend or terminate accounts that provide false information or otherwise violate these Terms.
5. Prescription uploads and pharmacy responses
If you choose to upload a prescription or medication request, you are solely responsible for the accuracy and legibility of the information you provide. MediMatch relays your request to pharmacies but does not verify, guarantee, or endorse the accuracy of any response, stock availability, pricing, or suitability of any medication or generic alternative offered. Always confirm details directly with the pharmacy, and consult your doctor or pharmacist with any questions about your prescription or treatment.
6. Pharmacy listings and availability information
Pharmacy listings, services, opening hours, stock, and availability information displayed in the Services are provided by third-party pharmacies or aggregated from public sources, and may be inaccurate, out of date, or change without notice. MediMatch does not guarantee that a pharmacy shown as "open" or as stocking a medication will in fact be open or have that medication available when you arrive. Always contact the pharmacy directly to confirm before traveling.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
- Impersonate any person or entity, or misrepresent your affiliation with a pharmacy, doctor, or other party.
- Upload content that is false, misleading, infringing, or that you do not have the right to share.
- Scrape, harvest, or use automated means to access or collect data from the Services without our written permission.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems.
- Use the Services to send spam or unsolicited communications to pharmacies or other users.
8. Intellectual property
The Services, including our branding, logos, design, text, and software, are owned by MediMatch or our licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent. You retain ownership of content you submit (such as a prescription image), and you grant us a limited license to use it solely to provide the Services to you.
9. Third-party services and links
The Services use or link to third-party services, including Google Maps Platform for maps and directions, and messaging services such as WhatsApp and email for contacting pharmacies. Your use of those third-party services is subject to their own terms and privacy policies, and MediMatch is not responsible for their content, accuracy, or availability.
10. Disclaimers
The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any medication or pharmacy information will be accurate or available.
11. Limitation of liability
To the maximum extent permitted by law, MediMatch and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services, including reliance on any pharmacy or medication information obtained through the Services. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us, if any, in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold MediMatch harmless from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
13. Termination
You may stop using the Services and request deletion of your account at any time by contacting us. We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other reason, including discontinuing the Services altogether.
14. Additional terms for App Store and Google Play users
If you downloaded the app from Apple's App Store, you acknowledge that:
- These Terms are between you and MediMatch only, not Apple, and Apple is not responsible for the app or its content.
- Apple has no obligation to furnish any maintenance or support services for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
If you downloaded the app from Google Play, your use is also subject to Google Play's then-current terms of service, and Google is not responsible for the app or these Terms.
15. Governing law and disputes
These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts of South Africa, except where applicable law requires otherwise.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you through the Services or by email. Continuing to use the Services after changes take effect means you accept the updated Terms.
